Please note, this is a preliminary TOS agreement. While we don't expect anyone to have any real problems with it, you never know, so we post it here for your inspection. If we make any changes to this agreement, we will post a notice in the RingSurf News area on the front page, and you can come back here to see them.

Terms of Service

RingSurf is basically a hosting and directory service. It is our policy to offer and open, and relatively unrestricted access to our service, with regard to the type of content allowed. The Service provided by RingSurf allows related website to form together into easily navigable groupings called Net or Web Rings. While we provide the navigation system for visiting member sites within a ring, each page you visit is hosted on a completely different server owned and operated by another company. We have no control over, access to, or responsibility for the content provided by these pages, including images, links, trademarked material or other content. Because of this, by using our system and viewing member site, you understand and agree that you may be exposed to images and other material that you find objectionable, indecent, or otherwise offensive. If the content or material found on a member site concerns you, please contact the operator/owner of the website in question.

Due to possibility of exposure to adult or mature content, and the collection of personal information (name, email address, and year of birth), we cannot allow children under the age of 14 to create or join a RingSurf hosted Net Ring. This does not mean that children under the age of 14 may not navigate your RingSurf Net Ring hosted on yours or other members sites, or that they cannot visit the RingSurf Directory and locate your Ring. It just means they cannot create their own Ring, or become a member of a Ring. This does not apply to members who joined before September 21, 2000.

Although we do not actively monitor Content on the RingSurf site, and we try to be very broad in what will be allowed on RingSurf, we do automatically forbid the following types of Content:

• Promoting or conducting illegal activities. Such information if found, will be reported to the appropriate authorities.

• Child Pornography. Yes this falls under illegal activities, but these some 'people' don't seem to get it. If any Content is found to even remotely promote child pornography, or otherwise promoting the exploitation or abuse of children, we shall gleefully turn over any and all information we can to the proper authorities.

• Racial/Religious/Sexual Hatred or Bigotry. While we support the First Amendment, we also have the right to refuse to host such material. If you want to promote such beliefs, go somewhere else.

Adult Content Rings
Adult or more specifically, sexually oriented Content is only allowed in the RingSurf Directory Adult categories. If your ring is found to have Adult content, and is not currently under an Adult category, it will be moved into one. Adult sites are not listed in the main RingSurf directory, nor any of the Top 100 lists. Please understand, this is done to protect our user under the age of 18. Adult rings can be found by using the search system, or by manual going to the Adult area of the Ring Directory (http://www.ringsurf/Adult).

Content Posted to RingSurf
For Content you make available on the RingSurf website, including descriptions, links and images, you grant RingSurf the world-wide, royalty free and non-exclusive license to reproduce and publish such Content, for the sole purpose of promoting the Service itself. This license remains in effect only for as long as you continue to include such Content on the Service and will end at the time you delete such Content from the Service.

What the above means in real world terms:
You are in no way giving up the ownership of your material. That's where the non-exclusive part comes in. You are simply granting us the rights to use such material to help advertise RingSurf itself in order to attract more users. It means we can display your RingSurf Net Ring, and mention your Ring in promotions and advertising that are designed to bring more people over to RingSurf. For example, if CNN were to decide to do a story on us (hehe that would be nice!), and they wanted to show a few of the Rings that are available on RingSurf, you are granting us permission to allow that. If you ever decide to leave RingSurf and remove your Ring, all such rights and permissions that you granted us end at that time.

Please understand we are very aware of why many of our new members have come over to RingSurf. We have no intention of trying to take over the rights of your property, or limit your power and authority as RingMaster of your Rings, and we are trying to be sure we are very clear about that. All we are asking is the right to use your Ring material to help promote RingSurf, as long as you are a member. If there is still any confusion or question on this, visit the Contact Center and let us know.

Reserved Rights and Indemnity
You agree to indemnify and hold RingSurf, and its affiliates and agents harmless from any claim, liability, loss, or demand, including reasonable attorneys' fees due to or arising out of content you make available through the Service, your use of the Service, your connection to the Service, your violation of these Terms of Service, or your violation of any rights of another. We also reserve the following rights:

1. To deny, remove or block any Ring and Ring Information from the Service with notice, for any reason, including tampering or interfering with the function of the Service, violation of these Terms of Service, and lack of use.

2. To adopt, maintain, or reassign any Ring and Ring information that appear to have been abandoned.

3. To modify or discontinue this Service for any reason, either temporarily or permanently, without notice. You agree that RingSurf shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

4. Upon leaving the Service, Ring Members and Ringmasters agree to remove all RingSurf related data, including links supplied by RingSurf, and trademarks from their web site.

DISCLAIMER OF WARRANTY

1. QUIKLINK INTERACTIVE, INC. MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF THIS SERVICE OR ABOUT ANY CONTENT OR INFORMATION MADE ACCESSIBLE BY THE SERVICE, FOR ANY PURPOSE. THE SERVICE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.

2. QUIKLINK INTERACTIVE, INC. MAKES NO WARRANTY THAT (i) THE SERVICE WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, AND (iv) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

LIMITATION OF LIABILITY

QUIKLINK INTERACTIVE, INC. AND ANY OF ITS AGENTS SHALL NOT BE HELD LIABLE UNDER ANY THEORY FOR ANY DAMAGES SUFFERED BY YOU OR ANY USER OF THE SERVICE, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER LOSSES (EVEN IF QUIKLINK INTERACTIVE, INC. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) UNAUTHORIZED OR ACCIDENTAL LOSS OR ALTERATION OF YOUR DATA OR TRANSMISSION; OR (iii) ANY OTHER MATTER RELATING TO THE SERVICE.
